During the hearing of a petition filed by the son of senator Azam Swati, the Sindh High Court (SHC) restrained the provincial police from arresting the PTI leader in any further cases. During the hearing, the SHC also issued notices to Inspector General of Police Ghulam Nabi Memon and directed him to submit a detailed report on all FIRs against Azam Swati by Wednesday. The SHC also ordered the IGP to provide English translations of all the FIRs lodged against Swati. If the IGP fails to provide the required clarifications, the court has to take action against him.
In a criminal complaint filed against Swati, it was alleged that he was tweeting against the armed forces. The tweets allegedly sought to create a rift between the military personnel. It was also a message directed against state institutions. The senator's arrest has been condemned by the PTI party. The party has alleged that the arrest was a part of the government's crackdown against dissenting voices in the country. The party's legal counsel, Babar Awan, said the raid occurred without a search warrant.
The senator's son Usman Swati has filed a fresh petition in the Sindh High Court seeking to quash all the cases against his father. In this case, he alleged that the arrest of his father was a violation of his right to freedom of speech and he asked for an immediate hearing. In this hearing, the SHC slammed the provincial police for their arrest. The court directed the IGP to provide all the relevant details to the court by December 14. If the details are not given, the court has to take action against the IGP.
The IGP's response was that all the cases against Azam were filed privately. He requested additional time to gather information, but Justice Agha declined his request and asked the IG to prepare a response by Wednesday. During the hearing, the IGP also stated that the investigation had been "very bad". After the hearing, the SHC ordered the IGP to resign.
The IGP argued that the Supreme Court had already made it clear that multiple cases could be registered against a person. But the court asked him where the common people could seek justice. The IGP responded by saying that the court did not trust him. The court has no choice but to adopt the same attitude as it did with the prosecutor general. The court also questioned the registration of several cases under a single charge. The IGP replied that the court did not trust him and the FIRs were lodged in private.
The Sindh high court ordered the IGP to prepare a full report on the cases against Azam Swati by December 15. It also directed the IGP to submit an English translation of all FIRs against Swati. The court warned the IGP that it would take action against him if the clarifications are not provided. It also asked the SSPs to brief the court on the matter during the next hearing.
